A High Court legal action taken by Claremorris cattle dealer, Mr Finbar Tolan against Aurivo Co-operative Society, formerly Connacht Gold Co – operative Society, for breach of contract has been dismissed in its entirety by the President of the High Court, Justice Nicolas Kearns.

The case which has been heard over past four days, concluded on Friday and the judge dismissed the claim.

In a statement from Aurivo, it says that an order for costs was made in favour of Aurivo Co-operative Society.  The Order includes all reserved and discovery costs.

It further goes on to say that the judgement by the President of the High Court fully exonerates Aurivo in respect of the alleged claims made by Mr Tolan.

Commenting, Martin Walsh, Head of Marts at Aurivo said: “This is an important judgement for the Co-operative. We are very satisfied that the correct and just decision was arrived at by Justice Kearns.”

Finbar Tolan was suing Aurivo for €6m in damages over alleged breach of contract, in relation to a credit agreement.
